What SIPSI is
SIPSI is the French online system for the prior posting declaration, the déclaration préalable de détachement. It is filed with the labour inspectorate, in French, and you receive an acknowledgement of receipt that is worth keeping.
Who files it, and when
The employer posting the workers files it, for every posting of employees to France, and before the posting starts. A foreign temporary-work agency files its own agency declaration, also before the worker is made available.
The representative in France
The declaration has to name a representative in France who acts as the contact for inspectors for the whole posting. Nothing in particular is required of the person, and it can be the client or one of the posted workers, but they must agree beforehand.
Where it goes wrong
- Filing it in English. The declaration is made in French.
- Leaving out the representative, or naming someone who has not agreed.
- Not keeping it up to date. If the posting is cancelled, the declaration is cancelled, and if the planned dates change, it is changed.
- Missing the long-posting step. Beyond 12 months, a reasoned declaration has to be filed before the 12 months run out, or French labour law applies more fully from the 13th month.
- Forgetting the construction card. Posted construction workers also have to be declared to CIBTP France to get a carte BTP before the posting, and after the SIPSI declaration. Workers show the card on request to inspectors, the project owner or the client.
What happens if it is missed
Missing these duties can bring administrative fines, counted per worker, and repeat failures are treated more severely.
How Obtempera helps
Obtempera does not file the declaration for you. It holds France's requirements for each worker, keeps the SIPSI acknowledgement and the carte BTP as evidence, and shows reviewers one status per worker, so a missing step is visible before the posting begins.
